RAIL HERO AND LAWYER SETTLE SUITS

Subway Superman Wesley Autrey and his lawyer have settled lawsuits they filed against each other over a contract they signed to exploit his heroism.

Autrey had accused lawyer Diane L. Kleiman and her business partner, Marc Antonio Esposito, of having him sign an unfair contract that gave them most of any money he earned because of his sudden fame.

In January, Autrey rescued a man who had fallen into the path of a subway train by lying on top of him as the cars passed over their heads. He became the toast of the city and was honored by President Bush during the State of the Union Address.

Kleiman sued Autrey for legal fees and compensation for damage to her reputation. She denied she cheated the 50-year-old construction worker, and said he made her look like a money-hungry crook.

BISMARCK, N.D. (AP) - Prosecutors dismissed a felony conspiracy charge against two top executives of North Dakota's workers compensation agency Friday, days before they were to appear in court to make their pleas.

Sandy Blunt, the chief executive officer of Workforce Safety and Insurance, and Romi Leingang, the agency's investigations director, had been scheduled to be arraigned Wednesday on a charge of conspiring to disclose confidential driver's license photos.

The motion said an agency lawyer had told Leingang the photos she obtained from a Department of Transportation database were not confidential. Blunt may have relied on the mistaken legal advice as well, the dismissal motion said.

Prosecutors learned of the new circumstances only a few days ago, and then decided to drop the charges, according to the motion.

Z' Wears the C'

'Z' WEARS THE 'C': The Syracuse Crunch announced on Friday, that they have named center Zenon Konopka as their team captain for the 2007-08 season. The club also announced that defenseman Dan Smith and right wing Steven Goertzen will serve as alternates at home games and centers Andrew Murray and Derek MacKenzie will wear the 'A' during road games.

Konopka, 26, becomes the ninth full-time team captain in franchise history (Dane Jackson, 1994-95, Mark Wotton, 1995-99, Brian Bunin, 1999-00, Mike Gaul, 2000-01, Sean Pronger, 2001-02, David Ling 2002-03, Darrell Scoville, 2003-04, Jamie Pushor, 2004-07.

Konopka appeared in 20 games with Syracuse last season notching 9 goals, 11 assists and 70 penalty minutes. He also played in 6 games with Columbus last year, tallying 20 penalty minutes.

WRIGHT CITY, Mo. (AP) - If Elvis was here today, he might say “Thank you, thank you very much" for an odd Missouri outpost's 17 years of making the case that the King never died.

But the burden of proof soon will fall on someone else's shoulders.Bill Beeny, the 81-year-old proprietor of The Elvis is Alive Museum, said he has placed his Elvis memorabilia on eBay in hopes someone else will take up the cause. Rep. Klein's Office Evacuated After Death Threat

Florida Rep. Ron Klein's office in Ft. Lauderdale was evacuated Thursday after officials there received a suspicious package in the mail.

"Earlier today, one of our staff members in our Broward County office opened a package that came in the mail, which contained suspicious content. As a precaution, we followed standard protocol procedures and contacted the Capitol Police, who instructed us to contact the Ft. Lauderdale police," a statement from Klein's office said Thursday.

The office was evacuated for a brief time while investigators examined the package. Police have not yet revealed what was found inside, but they did say that nothing harmful was found. A statement from Klein's office Thursday said no one was injured because of the incident. .

Regarding the letter in the paper on Italians being Latinos, it's my understanding that Latinos are people whose language is based on Latin, which would certainly include Italians because of the Romans and the people who were in Italy spoke Latin, which is the language that others are based on. Spaniards are also considered Latinos because their language is also based on Latin. Then, they carry that down to Mexico, Central America, South America. they speak a language that's based on Latin, therefore, they're Latinos. Whoopee-doo.

It would seem to me that the spaceport showroom that you're voting on for Hatch should be in Las Cruces since Las Cruces is halfway between all ports.

Gallardy's death] The combination of too hot a fire and a damaged air pack face piece contributed to the death of Altoona Fire Capt. Robert G. Gallardy two years ago, a federal investigation concluded. Gallardy, 47, was severely burned Oct. 23, 2005, during a class at the Pennsylvania State Fire Academy, where he was teaching experienced firefighters how to train new firefighters in handling emergency situations. Today is the second anniversary of his death. The federal report, issued last month, doesn’t specifically mention Gallardy by name only details about him, his training and the circumstances surrounding his death. The National Institute of Occupational Safety and Health believes that Gallardy’s air pack face piece had a ‘‘catastrophic failure’’ under excessive heat in the basement burn room at the academy, according to the report.
